DPP withdraws case against police officers linked to series of armed robberies, kidnappings

The Office of the Director of Public Prosecutions (ODPP) has withdrawn a case against two police officers and two civilians accused of a series of armed robberies, kidnappings and extortion targeting motorists and members of the public along Thika Road and its environs.

The decision followed an application by the main complainant, Cyrus Mwangi Wahongo, who told a Makadara court that he no longer wished to pursue the matter after recovering the money allegedly stolen from him.

In a letter dated October 1, 2026, and signed by Erick Mutuku, the ODPP said it had considered Wahongo’s sworn affidavit and his decision to withdraw his complaint while the matter was still at the investigation stage.

The suspects are Silas Onyango Okello, an interdicted police officer formerly attached to Kahawa Sukari, and Police Constable Oliver Juma Boge, formerly attached to Railways Police Station and interdicted since March 2018. The two civilians are Job Sidiga and Stephene Okello.

According to Sergeant David Waigua of the Directorate of Criminal Investigations (DCI) in Kasarani, the four allegedly operated using a grey Toyota Allion, registration number KCN 371M, to trail their targets before staging arrests, extorting money and robbing members of the public.

Wahongo told investigators that he was intercepted by the group, falsely accused of smoking bhang and robbed of KSh15,000.

Preliminary investigations had also linked the suspects to a separate robbery on September 16 in which KSh140,000 was allegedly stolen, as well as other reported incidents involving robbery with violence and rape in Mwihoko, Thika West, Githurai and Mwiki.

The prosecution’s case weakened after Wahongo failed to attend an identification parade at Kasarani Police Station. Sgt Waigua had summoned him to participate in the exercise, but the complainant told investigators that he had already been compensated and would not proceed with the case.

In his affidavit, Wahongo said he had voluntarily decided to withdraw his complaint and asked the authorities to terminate the proceedings. He further stated that his decision had not been influenced by threats, coercion, intimidation or undue influence from the suspects or their associates.

The ODPP noted that no formal charges had been filed against the four suspects, leaving the matter within the prosecution’s discretion at the investigative stage.

Citing Article 157(11) of the Constitution and its prosecution policy guidelines, the ODPP said the complainant’s refusal to cooperate had significantly affected the prospects of successfully prosecuting the case.

The prosecution nevertheless cautioned that the decision does not permanently close the file.

The ODPP said the matter remains subject to review and may be reopened if new evidence emerges or subsequent investigations establish that Wahongo was coerced or otherwise unlawfully induced to withdraw his complaint.
