Equity Bank staff charged with attempted theft after unauthorised acces

Ian Muhia Maina, an employee of Equity Bank Limited, has been charged at the Milimani Law Courts with attempted theft.

Maina has been charged with unauthorised access contrary to Section 14(1) of the Computer Misuse and Cyber Crime Act.

According to the charge sheet, the accused, with others not before the court, secured unauthorised access to a computer system belonging to Equity Bank Limited.

The prosecution states that Maina duplicated Finacle user profiles with the intent to commit an offence, namely theft, on diverse dates between May 2026 and October 21, 2026.

In addition, the bank staff has also been charged with conspiracy to commit a felony contrary to Section 393 of the Penal Code.

The prosecution avers that Maina, on the same dates while at an unknown place, jointly with others, not before the court, conspired to commit a felony, namely attempted stealing by a servant, by duplicating the Finacle user profiles VM53601 and BC 23924 in the Equity Bank Limited banking system.

Appearing before Milimani Court Magistrate Irene Thamara on Friday, October 23, 2026, Maina denied all the charges, and a plea of not guilty has been entered.

The prosecution did not oppose the accused being released on bail and bond terms.

The court has freed him on a bond of Ksh600,000, with an alternative of paying Ksh200,000 cash bail.

“The accused is hereby granted a bond of Ksh600,000 with surety of the same amount; alternatively, he deposits Ksh200,000,” Magistrate Thamara directed.

Further, the court ordered the accused to attend all the court proceedings, failure to which his bail and bond terms will be cancelled.
