Malindi Court announces judgment date for Paul Mackenzie Shakahola case

Malindi High Court has moved the judgment date in the murder case against Paul Mackenzie and 30 co-accused to Monday, October 19, at 9am.

Malindi High Court has moved the judgment date in the murder case against Paul Mackenzie and 30 co-accused to Monday, October 19, at 9am.

The Malindi High Court has moved the judgment date in the murder case against Paul Mackenzie and 30 co-accused to Monday, October 19, at 9am.

In a court notice, Lady Justice Diana Kavedza-Mochache said the judgment would be delivered at the Mombasa Law Courts.

The court was expected to issue the ruling on October 16, however, Justice Kavedza-Mochache said the earlier directions on the judgment date had been varied.

“Take Notice that under the direction of Hon. Lady Justice Diana Kavedza-Mochache, the Judgement date for Case no. E003 of 2024 has been moved to 19th October 2026 at 9:00am at Mombasa Law Courts,” reads part of the notice dated October 9.

In the case E003 of 2024, Mackenzie and his co-accused face 191 counts of murder linked to the deaths of children whose bodies were recovered from Shakahola Forest in Kilifi County.

The charges relate to alleged offences committed between January 2021 and September 2023.

Court documents show the Office of Director of Public Prosecutions (ODPP), the accused have been charged in connection with the deaths of 11 identified children and 180 unidentified children.

On April 15, 2026, Justice Kavedza ruled that the prosecution had established a prima facie case against the accused and placed them on their defence under Section 211 of the Criminal Procedure Code.

The prosecution called 121 witnesses and presented evidence that included postmortem reports, expert testimony and findings from government analysts.

The case has also involved a dispute over the 191-count charge sheet.

At the start of the case, the defence argued that the number of charges and the particulars in the charge sheet could prejudice the accused’s right to a fair trial.

In April 2025, the Court of Appeal overturned an earlier High Court directive to reduce the number of murder counts, allowing the 191 charges to proceed.
