Court rules on petition to remove KUPPET Chairman, Omboko Milemba over MP role
The Employment and Labour Relations Court has halted a fresh challenge against Kenya Union of Post Primary Education Teachers (KUPPET) national chair Omboko Milemba, who also serves as Emuhaya Member of Parliament.
Justice Monica Mbaru ordered the petition to remain on hold pending determination of an earlier case, allowing Milemba to retain his KUPPET position as the court considers concerns raised over conflict of interest.
The latest dispute stems from the April 18 KUPPET elections, in which Milemba retained the national chairmanship, with the challenge questioning whether he can continue holding the union leadership position while serving as an MP.
The issue was the subject of court proceedings in 2025 seeking declarations over Milemba’s eligibility to hold multiple positions and requesting his removal as KUPPET chairperson and fresh union elections.
Milemba and KUPPET asked the court to suspend or strike out the latest petition, arguing that the matter should await the outcome of the existing case.
The petitioner maintained that the case was a separate challenge arising from the 2026 elections, which took place after the earlier proceedings had begun.
However, the court’s findings maintained that the underlying question concerning Milemba’s positions was already before the court.
The judge explained that allowing the matter to proceed independently could create the risk of inconsistent judicial findings.

The court directed that the latest petition be mentioned on October 1, 2026, and monitored alongside the earlier case.
Milemba has been actively carrying out duties in both his parliamentary and KUPPET leadership roles, particularly in recent weeks.
On Wednesday, August 19, he spoke in the National Assembly during debate on a petition tabled by Speaker Moses Wetang’ula on behalf of veterinary doctors and interns working in the public sector, who are seeking harmonisation of their salaries and allowances with those of medical doctors.
Milemba argued that salary harmonisation did not necessarily mean matching pay figures across professions, noting that wage differences within the same sector should be kept within a 25 per cent range, in line with principles he attributed to the International Labour Organisation.
In addition, as KUPPET chair, Milemba issued the Teachers Service Commission (TSC) with a seven-day strike notice on August 6, demanding the promotion of 50,000 teachers amid persistent concerns over stalled career progression.
