KCB senior executive Rosemary Chemutai buried hurriedly despite a court order
KCB senior executive Rosemary Chemutai buried hurriedly at her parents home in Kericho barely a day after her husband got an order stopping her burial.
Rosemary Koech, the late Head of Data at KCB Kenya, was buried yesterday after Kevin Kimwatu reportedly failed to serve her family with a court order that had stopped the burial over a dispute concerning her next of kin details.
Rosemary Koech was buried on Friday despite a court order stopping the burial, with questions now emerging over whether the order was served before the body was released.
A court had stopped the burial of Rosemary Koech after her estranged husband Kevin Kimwatu complained that he had been excluded from the funeral arrangements, but the burial still went ahead.
KCB says Rosemary Koech had listed her sister Judy Koech-Oyamo and her son Charles Migwe Kimwatu as her next of kin in its employment records, a detail now sitting at the centre of the burial dispute.
The court order expressly directed that the application be served upon the respondents before the matter returns to court on August 31.
The court document, issued by Hon Agnes Mwangi SPM at 9:33am on Friday, August 28, restrained the respondents, their relatives, servants, agents and employees from removing Koech’s body from Lee Funeral Home.
The court also barred the respondents from interring or burying her without Kimwatu’s consent or involvement and stopped funeral arrangements and burial without his participation.

However, the same order directed that the application be served upon the respondents.
The court had directed that the matter be mentioned on August 31 for further directions.
Kimwatu had moved to court on August 26, claiming he had been excluded from arrangements concerning his wife’s burial.
In his application, he said he was legally married to Koech, with the couple having wed at St Austin’s Catholic Church in Nairobi on August 24, 2013, and had four children.
Kimwatu told the court that although their marriage had faced challenges, they remained husband and wife.
He acknowledged that they had separated for about four months but said Koech had expressed a desire to return to their matrimonial home before her death.
He wanted to bury her at his ancestral home in Matasia, Ngong, Kajiado County.
Koech, 40, was a former KCB executive who served as head of data protection in the bank’s risk division. She died on August 21.
