Court closes burial dispute over KCB executive Rosemary Koech after husband withdraws case

Court closes burial dispute over KCB executive Rosemary Koech after husband withdraws case

The Milimani Law Courts has closed a burial dispute involving the family of KCB Head of Data Protection Rosemary Koech Kimwatu after her husband withdrew the suits he had filed over her burial.

Kelvin Migwe Kimwatu withdrew the cases after confirming Koech had been buried at night, according to details presented before the court.

The husband had challenged the burial arrangements and sought to be involved in decisions concerning the final rites.

“The applicant withdrew the application, and we had no objection to the application and the entire suit being withdrawn,” Lawyer Felix Keaton, representing the parents of the deceased, said.

“We take the view that that was a wise decision; we also wish to convey to you that they (parents) welcome the son-in-law together with the children or any other family member to visit the graveside of the deceased or even visit the family at any particular time,” he added.

Following confirmation that the burial had already taken place, Kimwatu declined to seek the exhumation of Koech’s remains or pursue contempt proceedings against her relatives or KCB.

Kimwatu told the court that he would leave what had happened to God and chose not to pursue further legal action over the burial.

The dispute was subsequently brought to an end after Koech’s parents agreed that her husband and their four children would have access to her graveside at any time.

The agreement paved the way for the closure of the matter at the Milimani Law Courts.

The case had attracted attention after the court was moved to intervene in the burial arrangements following a dispute between Kimwatu and his late wife’s family.

Koech’s family defended her night burial, saying the decision was guided by Kalenjin cultural traditions and not intended to create a dispute with her husband or his family.

Koech, 40, was found dead at her residence in the Ole Nairi area of Ngong on August 21, 2026.

An autopsy conducted by Chief Government Pathologist Dr Johansen Oduor at Lee Funeral Home established that she died by suicide.

Koech had built a distinguished career in law, technology, public policy and data protection.

She joined KCB in June 2022 as Data Protection Officer after serving as Public Policy Manager at Safaricom.

In June 2023, she was promoted to Head of Data Protection, overseeing the Group’s data protection compliance.
